Terms & Conditions

1. Agreement

These Terms & Conditions ("Terms") govern your purchase and use of any product or service supplied by Biztech Expert ("Biztech Expert", "we", "us", "our"), including our website at biztech.expert and every product listed in section 3.

By placing an order, paying an invoice, creating an account, or using any product, you agree to these Terms. If you do not agree, do not purchase or use our products. If you are accepting on behalf of a company, partnership, or other entity, you confirm you have authority to bind that entity, and "you" refers to that entity.

These Terms apply to the exclusion of any terms you may seek to impose, including any purchase-order or vendor-onboarding terms, unless we agree otherwise in writing signed by us.

2. Who we are

Biztech Expert is a digital products and services company based in Ahmedabad, Gujarat, India, providing websites, AI automation, social media management, advertising management, and voice automation to businesses.

Contact for all contractual matters: contact@biztech.expert · WhatsApp +91 63524 45717.

3. Our products

These Terms apply to each of the following. Where a product has specific conditions, they are stated in this section and in the sections that follow.

We may add, change, or retire products and features. Where a change materially reduces what you have already paid for, we will give you notice and a pro-rata remedy as described in section 16.

4. Accounts & access

Where a product requires an account, we will provision it for you after we receive payment and the information we need to set it up. You are responsible for keeping your login credentials confidential, for all activity under your account, and for the acts of any team member or contractor you give access to.

You must give us accurate information and keep it current. We may refuse, suspend, or close an account where information is false, where these Terms are breached, or where we are required to by law or by a platform provider.

5. Payment, paid up front

All products are supplied on a prepaid basis. Service begins only after payment is received in full and cleared. We are not obliged to begin work, provision access, or continue service before payment is received.

• Subscriptions are billed in advance for the period you select, monthly, quarterly, or annual. Your service runs to the end of the paid period.
• Project work such as websites is billed as stated in your quotation, typically a booking amount before work starts and the balance before launch.
• Renewals are due before the current period ends. We will remind you in advance. If renewal is not paid, service stops at the end of the paid period.

Prices are in Indian Rupees (INR) and exclude applicable taxes, including GST, which will be added where required by law. We may change prices with notice before your next renewal; a price already paid for a current period will not be increased mid-term.

If a payment is reversed, charged back, or fails after service has started, we may suspend the service and recover the amount due, including any charges we incur.

6. Plans, limits & fair use

Each plan includes stated allowances, for example numbers of users, connected channels, contacts, messages, calls, published posts, or AI generations. These are part of what you are buying, and exceeding them may require an upgrade or an add-on pack.

Fair use. Plans are priced for normal business use. We may apply reasonable technical limits, throttle, or ask you to upgrade where usage is abnormal for the plan purchased, for example bulk or automated activity far beyond typical use, reselling access, or use that degrades the service for others. We will tell you before acting where it is reasonable to do so.

We do not meter your goodwill: if a limit is unclear, ask us and we will confirm it in writing before you commit.

7. AI features

Some products include AI-generated text, images, video, voice, or calls. These features are provided to you as part of your subscription. AI processing is carried out using infrastructure and providers that we select, configure, and pay for. You do not need to obtain, supply, or manage any third-party AI account, key, or subscription to use these features, and any such arrangements on our side are internal to us and form no part of your contract.

AI output is probabilistic and may be inaccurate, incomplete, or unsuitable for a particular purpose. You are responsible for reviewing AI output before publishing or relying on it, including for factual accuracy, legal compliance, and suitability for your brand. You must not present AI-generated content as human-authored where the law or a platform requires disclosure.

AI features depend on third-party providers. We may change providers, models, or the way AI features are delivered without notice, provided the core function you purchased continues to be supplied.

8. Social & messaging platforms

Several products operate through third-party platforms, Meta (Facebook, Instagram, WhatsApp), Google, LinkedIn, X, and others. When you connect an account, you authorise us to act on your behalf within the permissions granted, for the purpose of delivering the product.

You are responsible for holding the necessary accounts, for complying with each platform's terms, developer policies, advertising policies, and content rules, and for the content published or sent through your accounts. Platform decisions are outside our control: account restrictions, ad rejections, API changes, policy changes, rate limits, or loss of access may affect the product, and we are not liable for them.

You confirm you have the right to use every account, phone number, and audience list you connect, and that you have any consent required to message the people you contact.

9. Your content

You retain ownership of the content you supply or publish through our products, text, images, video, brand assets, contact lists, and messages ("Your Content"). You grant us a limited, non-exclusive licence to host, process, transmit, and display Your Content solely to provide the products you have purchased.

You confirm you own or control all rights needed in Your Content, and that it does not infringe anyone's rights or breach any law or platform rule.

Where we create content for you, website copy, designs, ad creative, AI-generated media, the deliverable is licensed to you for use by your business on payment in full. We may retain and reuse underlying tools, templates, components, and know-how, and may show the work in our portfolio unless you ask us in writing not to.

10. Acceptable use

You agree not to use our products to:

• send spam, unsolicited bulk messages, or messages to people who have not consented where consent is required;
• defame, harass, threaten, or violate the rights of others, including privacy and publicity rights;
• publish or distribute unlawful, obscene, infringing, or deceptive material, including misleading advertising;
• infringe copyright, trademark, or other intellectual-property rights;
• impersonate any person or misrepresent your affiliation with any person or entity;
• upload malware or code intended to disrupt any service;
• probe, bypass, or interfere with security, authentication, or rate limits;
• resell, sublicense, or provide access to our products to third parties except as your plan expressly allows;
• use the products in a way that violates any applicable law, including telecom, advertising, consumer-protection, and data-protection law.

We may suspend or terminate service immediately, without refund, where we reasonably believe this section has been breached or where a platform or regulator requires it.

11. No guarantee of results

We provide tools and services. We do not guarantee any specific outcome, including search rankings, website traffic, engagement, follower growth, lead volume, lead quality, conversion rates, cost per lead, sales, revenue, or advertising performance. Any figure, example, or case study we share is illustrative of past work, not a promise about your results.

Results depend on factors outside our control, including your market, offer, pricing, competition, platform algorithms, and advertising budgets.

12. Third-party services

Our products depend on third-party providers, hosting, infrastructure, AI models, messaging platforms, payment processors, and telecom carriers. These are not under our control and we are not responsible for their acts, omissions, outages, or policies. Where we resell or bundle a third-party service, we pass it through as part of our product; our liability for it is limited by section 19 in the same way as for anything else we supply.

13. Intellectual property

Our products, platform, software, designs, documentation, and brand, including the names Biztech Expert, BE Agents, BE Socials, BE Ads, and Biztech Voice, and all associated logos, are our property or that of our licensors and are protected by intellectual-property law. These Terms grant you a right to use the products as described; they do not transfer ownership of the platform or our brand.

You may not copy, modify, reverse-engineer, scrape, or attempt to derive the source of our platform, or remove proprietary notices, except where such restriction is prohibited by law.

Parts of our platform incorporate software licensed under the GNU Affero General Public License version 3 (AGPL-3.0) and other open-source licences. To the extent the AGPL-3.0 requires us to offer corresponding source code to users interacting with that software over a network, we do so on request: write to contact@biztech.expert and we will provide it. Your rights in that source code are governed by its licence, and nothing in these Terms restricts rights you have under it.

14. Availability

We work to keep products available and secure, but we do not promise uninterrupted service. We may perform maintenance, apply updates, or suspend access to protect the service, our customers, or third parties. Unless a separate written service-level agreement signed by us says otherwise, no service level, uptime commitment, or credit regime applies.

15. Suspension & termination

We may suspend or terminate your access if you fail to pay, breach these Terms, use the products unlawfully, or if a platform or authority requires it. Where practical we will give you notice and a chance to remedy a curable breach.

You may stop using a product at any time; cancellation takes effect at the end of the paid period and does not entitle you to a refund except as stated in section 16.

On termination we may deactivate your access and, after a reasonable period, delete your data in line with our Privacy Policy. Export anything you need before your paid period ends, we are not obliged to retain or restore it afterwards.

16. Cancellation & refunds

Because products are prepaid and capacity is reserved for you, fees are non-refundable except in these cases:

• we cancel a product before supplying it, in which case we refund the unearned portion;
• we materially reduce a feature you have already paid for and cannot provide a reasonable substitute, in which case we refund the unused portion of the current period;
• a refund is required by applicable law.

Project work already performed, design, development, setup, onboarding, and configuration, is not refundable. Booking amounts secure capacity and are non-refundable once work has begun.

17. Indemnity

You agree to indemnify and hold harmless Biztech Expert, its directors, employees, and agents from any claim, loss, liability, cost, or expense (including reasonable legal fees) arising from: Your Content; your use of the products; your breach of these Terms; your breach of any platform's terms or any law, including data-protection, telecom, and advertising law; or any claim by a third party, including a person you messaged or advertised to, relating to your conduct.

18. Disclaimer of warranties

To the maximum extent permitted by law, our products and services are provided "as is" and "as available". We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that any product will be error-free, uninterrupted, secure, or that defects will be corrected.

Nothing in these Terms limits any warranty or right that cannot lawfully be limited, including your statutory rights as a consumer where consumer law applies to your purchase.

19. Limitation of liability

To the maximum extent permitted by law, Biztech Expert shall not be liable for any indirect, incidental, special, punitive, or consequential loss, or for loss of profit, revenue, business, goodwill, opportunity, anticipated savings, leads, data, or data-use, however arising, even if we were advised of the possibility.

Our total aggregate liability arising out of or in connection with these Terms or any product, whether in contract, tort, negligence, or otherwise, is limited to the total fees you actually paid us for the specific product giving rise to the claim in the three (3) months immediately before the event giving rise to the claim.

We are not liable for anything caused by third parties, including platform suspensions, API changes, AI provider behaviour, telecom or carrier failures, or your own acts and omissions. Nothing in these Terms excludes liability for fraud, wilful misconduct, death, or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.

20. Confidentiality

Each of us will keep the other's confidential information confidential and use it only to perform this agreement. This covers pricing, credentials, contact lists, unpublished creative, and non-public business information. It does not cover information that is public, already known, independently developed, or required to be disclosed by law, and where disclosure is required, we will notify the other party where lawful.

21. Governing law & disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer protections, the courts at Ahmedabad, Gujarat have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or our products.

Before starting proceedings, you agree to raise the dispute with us in writing at contact@biztech.expert and allow us 30 days to resolve it in good faith.

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between us. We may subcontract parts of our work to trusted providers; we remain responsible for the standard of what we supply.

If any provision is found unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver. These Terms, together with your order or invoice, are the entire agreement between us on their subject matter.

22. Changes to these Terms

We may update these Terms from time to time. Material changes affecting products you already pay for will be notified to you by email to the address we hold, or by a prominent notice in the product, before they take effect. Changes apply from your next renewal. If you do not accept a change, you may cancel before it takes effect and use the service until the end of your paid period.
